{"id":1346,"date":"2021-04-08T15:27:25","date_gmt":"2021-04-08T15:27:25","guid":{"rendered":"http:\/\/cpaudit.com.gt\/?p=1346"},"modified":"2021-04-08T15:27:30","modified_gmt":"2021-04-08T15:27:30","slug":"el-leasing-o-arrendamiento-con-opcion-a-compra-y-el-leasing-operativo","status":"publish","type":"post","link":"https:\/\/cpaudit.com.gt\/index.php\/2021\/04\/08\/el-leasing-o-arrendamiento-con-opcion-a-compra-y-el-leasing-operativo\/","title":{"rendered":"EL LEASING O ARRENDAMIENTO  CON OPCI\u00d3N A COMPRA Y EL LEASING OPERATIVO"},"content":{"rendered":"\n<p><\/p>\n\n\n\n<p class=\"has-text-align-justify\">El Leasing o arrendamiento con opci\u00f3n a compra va en aumento en nuestro pa\u00eds, ante ello, el Congreso &nbsp;de la Rep\u00fablica de Guatemala, aprob\u00f3 el <strong>Decreto 02-2021 \u201cLEY DEL LEASING\u201d<\/strong> que regula los contratos de arrendamiento,&nbsp;viniendo a fomentar&nbsp;el desarrollo de la peque\u00f1a y mediana empresa.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">La finalidad de esta Ley es crear el marco legal que permita garantizar y brindar seguridad jur\u00eddica a la forma en la que se llevan a cabo las operaciones de Leasing. Permitiendo que las empresas, personas y el Estado alquile equipos con opci\u00f3n de compra.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Con la finalidad de conocer la terminolog\u00eda utilizada en este tipo de operaciones de comercio, a continuaci\u00f3n hacemos referencia a los t\u00e9rminos legales m\u00e1s comunes utilizados:<\/p>\n\n\n\n<p><strong>Arrendador, Arrendadora, Arrendante:<\/strong> (quien entrega el bien)<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Persona, patrimonio o ente que el o los bienes en calidad de leasing a uno o m\u00e1s arrendatarios, en los t\u00e9rminos y condiciones acordados por las partes en el respectivo contrato de leasing.<\/p>\n\n\n\n<p><strong>Arrendatario:<\/strong> (quien recibe el bien)<\/p>\n\n\n\n<p>Persona, ente o patrimonio que al celebrar el contrato de leasing, obtiene derecho al uso, goce y disfrute del bien objeto de leasing, en los t\u00e9rminos y condiciones acordados por las partes en el respectivo contrato de leasing.<\/p>\n\n\n\n<p><strong>Contrato de Leasing:<\/strong><\/p>\n\n\n\n<p>Es el contrato mediante el cual el arrendador adquiere para uso del arrendatario bienes a cambio de una renta o cuota por un plazo determinado.<\/p>\n\n\n\n<p><strong>Tipos de Contrato de Leasing:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Contrato de Leasing Financiero, Arrendamiento Financiero o Arrendamiento Financiero con Opci\u00f3n a Compra.<\/li><li>Contrato de Leasing Financiero Inmobiliario, Arrendamiento Financiero Inmobiliario o Arrendamiento Financiero Inmobiliario con Opci\u00f3n a Compra;<\/li><li>Contrato de Leasing Operativo o Arrendamiento operativo.<\/li><\/ul>\n\n\n\n<p><strong>Lease:<\/strong> Arrendamiento.<\/p>\n\n\n\n<p><strong>Renta o cuota:<\/strong><\/p>\n\n\n\n<p>Es la prestaci\u00f3n que el arrendatario de un contrato de Leasing se obliga a pagar al arrendador, por el uso o goce de los bienes objeto de arrendamiento, por la vigencia del plazo del contrato.<\/p>\n\n\n\n<p><strong>Valor residual:<\/strong><\/p>\n\n\n\n<p>Es el monto que las partes de un contrato de leasing financiero con opci\u00f3n a compra han acordado que corresponder\u00e1 pagar al arrendatario que ejerza la opci\u00f3n de compra de los bienes objeto de leasing.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">La Ley de Leasing hace referencia a los derechos y obligaciones derivados de la celebraci\u00f3n de un contrato leasing, regulados en los art\u00edculos 7, 8 y 9, en los art\u00edculos 10 al 19 hace referencia a la formalizaci\u00f3n y efectos del contrato leasing, los art\u00edculos 20 al 23 se refieren a la opci\u00f3n a compra y transmisi\u00f3n de dominio, las fuentes de financiamiento se describen en los art\u00edculos 24 al 29, y las disposiciones tributarias se mencionan en los art\u00edculos 30 al 37, finalmente los art\u00edculos 38 al 45 hacen referencia al r\u00e9gimen procesal que se debe seguir en caso de incumplimiento de los t\u00e9rminos del contrato.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">A fin de evitar caer en problemas de tipo legal se hace necesario que los comerciantes o empresarios y en general todo contribuyente, cuente con la asesor\u00eda de expertos conocedores en materia fiscal, \u00a0como parte de nuestros portafolio de servicios de consultar\u00eda empresarial ponemos a disposici\u00f3n nuestros servicios de Asesor\u00eda y Consultar\u00eda Fiscal a precios accesibles, tienes dudas o necesitas ayuda con la gesti\u00f3n \u00a0de impuestos, no dudes en consultarnos.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>El Leasing o arrendamiento con opci\u00f3n a compra va en aumento en nuestro pa\u00eds, ante ello, el Congreso &nbsp;de la Rep\u00fablica de Guatemala, aprob\u00f3 el Decreto 02-2021 \u201cLEY DEL LEASING\u201d que regula los contratos de arrendamiento,&nbsp;viniendo a fomentar&nbsp;el desarrollo de la peque\u00f1a y mediana empresa. -->\n<p><strong>Renta o cuota:<\/strong><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Es la prestaci\u00f3n que el arrendatario de un contrato de Leasing se obliga a pagar al arrendador, leasing, se encuentran regulados en los art\u00edculos 7, 8 y 9, los art\u00edculos 10 al 19 hacen referencia a la formalizaci\u00f3n y efectos del contrato leasing, los art\u00edculos 20 al 23 se refieren a la opci\u00f3n a compra y transmisi\u00f3n de dominio, las fuentes de financiamiento se describen en los art\u00edculos 24 al 29, y las disposiciones tributarias se mencionan en los art\u00edculos al 37, finalmente los art\u00edculos 38 al 45 hacen referencia al r\u00e9gimen procesal que se debe seguir en caso de incumplimiento de los t\u00e9rminos del contrato.<\/p>\n<!--
